OFFICIAL RULES SHOP FOR YOUR SHOP SWEEPSTAKES 1. NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. Sweepstakes open to legal residents of the 50 United States and District of Columbia (“DC”), who are 18 years or older as of 09/1/2008. Employees and directors of Franklin International (“Sponsor”), Arrowhead Promotion & Fulfillment Co., Inc. (“Administrator”), and their parent entities, subsidiaries and affiliated companies, advertising, promotion or production agencies, web masters and web suppliers, (and their respective IRS dependents, immediate family members [children, spouse, parents, siblings] and individuals residing in their same household) are not eligible to participate. Void where prohibited. By participating, entrants agree to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to this Sweepstakes. Sweepstakes begins on 9/1/2008 and ends on 10/31/2008 (“Promotion Period”). 3. RANDOM DRAWING: One (1) Grand Prize winner, one (1) First Prize Winner and one (1) Second Prize Winner will be selected in a random drawing to be held on or about 11/3/2008 from among all eligible online entries received. Drawing will be conducted by Administrator, whose decisions are final and binding in all matters relating to this Sweepstakes. By participating, entrants agree to be bound by these Official Rules and the decision of the judges, whose decision shall be final. Grand Prize winner will be notified by telephone or mail within 5 days of the drawing date. The Grand Prize winner will be required to sign an Affidavit of Eligibility and Liability Release and Publicity Release (where legal) within 10 days of notification. Noncompliance within this time period, or return of any prize or prize notification as undeliverable, will result in disqualification, and an alternate winner will be selected. 4. PRIZE/ODDS/APPROXIMATE RETAIL VALUE (“ARV”): One (1) Grand Prize: Winner will receive a $1,000.00 Lowe’s Gift Card and Winner and guest receive round-trip coach class transportation for two (2) people (from the major airport nearest winner’s home to Boston, MA. If winner resides within 150 miles of Boston, MA, ground transportation may be substituted in lieu of air transportation at Sponsor’s sole discretion.) two (2) nights double occupancy hotel accommodations; a visit to the set of the New Yankee Workshop, meet & greet with Norm Abram and show crew, autographs/photographs with Norm Abram; a years supply of Titebond Wood Glue (up to $300.00), Titebond gear and $200.00 spending money. The approximate retail value (“ARV”) of the prize is $3,500.00, depending on winner’s point of travel origin. First Place Prize: One (1) $500 Lowe’s Gift Card and $50 in Titebond Glue, (ARV is $550.00); and Second Place Prize: One (1) $250 Lowe’s Gift Card and $50 in Titebond Glue, (ARV is $300.00), Total ARV is $4350.00 All other expenses and costs not expressly listed above including, but not limited to, ground transportation (both to and from the airport to the New Yankee Workshop set and otherwise) meals, telephone calls, gratuities, taxes and souvenirs associated with acceptance and use of the prize are solely the winner’s responsibility. All travel must be taken on dates specified by Sponsor; travel dates will be in November 2008 and no alternative travel dates will be available. Airport(s), itinerary, carrier(s), hotel and episode seating will be selected by Sponsor in its sole discretion. Winner and travel guest must travel on same itinerary. The designated travel companion will also be required to execute a travel release prior to the issuance of travel documents. Travel companion must be at least 18 years of age at the time of travel. Winner and guest must have all necessary identification and/or documents for air travel (e.g. a valid driver’s license or other acceptable photo ID) Prize is subject to Sponsor’s standard warranties, terms and conditions. Restrictions may apply. Prize consists of only the items specifically listed as part of the prize. All expenses, including any federal, state, or local taxes (income or otherwise), associated with acceptance and use of the prize are winner’s sole responsibility. Prize cannot be transferred, assigned, substituted, or redeemed for cash, but Sponsor reserves the right to substitute any prize with prize of equal or greater value, should any prize become unavailable or otherwise in Sponsor’s sole discretion. Odds of winning are dependent on the total number of eligible entries received. 5. GENERAL RULES: Sponsor, Administrator, and their respective agencies are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed telephone or computer hardware or software or other technical failures, unauthorized human intervention, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic, including without limitation, the incorrect or inaccurate capture of entry information online regardless of cause. Once submitted, entries become the exclusive property of Sponsor and will not be acknowledged or returned. Administrator’s computer will be the official time clock for the Sweepstakes. Any use of robotic, automatic, programmed or like entry methods will void all entries affected by such methods and be deemed tampering. Entry material/data that has been tampered with or altered is void. The potential Grand Prize winner (or winner’s parent or legal guardian if winner is deemed a minor in the state of his/her residency) is required to complete, sign and return an Affidavit of Eligibility, a Liability Release and Publicity Release (where legal) within ten (10) days of notification. If documents are not returned on a timely basis, or if prize is returned as non-deliverable, or if winner is found to be ineligible or not in compliance with these Official Rules, such prize will be forfeited and awarded to an alternate winner. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND IF SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. Entrants must provide a valid e-mail address. Sponsor reserves the right, at its sole discretion, to cancel/suspend/modify the online portion of the Sweepstakes if it becomes corrupted in any manner such that it cannot be conducted as originally planned or if there are any other causes which Sponsor, in the sole opinion of the Sponsor, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes. In any such event, Sponsor may select a winner by random drawing from all eligible online entries received prior to and/or after (if appropriate) the action taken by Sponsor. In case of dispute as to identity of a winner , entry will be declared made by the registered user of the e-mail account, and, if the prize is won and such registered user is a valid entrant, the prize will be awarded to the registered user. Neither Sponsor, Administrator, nor their respective agencies, or affiliates are responsible for lost, late, damaged, destroyed, delayed, stolen, misdirected, incomplete, or illegible entries. Entrants (or entrant’s parent or legal guardian, if entrant is deemed a minor in the state of his/her residency), by participating in this Sweepstakes, hereby waive and release, and agree to hold harmless the Sponsor, Administrator, its respective parents, subsidiaries, affiliates, distributors, licensors, advertising and promotion agencies, web masters and web suppliers, and all of their respective officers, directors, employees and representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death, and /or property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of any prize, or their participation in this Sweepstakes, or any prize-related activity whether under a theory of contract, tort (including negligence and/or fraud), warranty or other theory. By participating in this Sweepstakes, entrants (or entrant’s parent or legal guardian if entrant is deemed a minor in the state of his/her residency) agree to be bound by the Official Rules and the decisions of the Administrator and/or Sponsor. Except where prohibited by law, by accepting a prize, winner (or winner’s parent or legal guardian if winner is deemed a minor in the state of his/her residency) agrees that Sponsor and its related and affiliated companies may use the winner’s name, address (city, state), photograph, videotape, likeness, and/or prize information for advertising, publicity and promotional purposes, and may use statements made by or attributed to winner relating to Sponsor, its related and affiliated companies or this Sweepstakes, and grants to Sponsor and its related and affiliated companies any and all rights to said use without further notice and/or compensation except where prohibited by law. 6. GOVERNING LAW: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in or for Franklin County, Ohio. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, awarding of or use of prizes by winners or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of State of Ohio, without giving effect to any choice of law or conflict of law rules (whether of the State of Ohio or any other Jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Ohio, Each entrant waives its right to a jury trial 7.
